Facilitating Opportunities for Skilled Professionals: Czech Republic’s Updated Employment Legislation

Starting July 1, significant changes to the Czech Republic’s Employment Act will come into effect. These modifications, previously announced by the Czech government, aim to streamline the hiring process for non-EU nationals from select countries. This move is part of the country’s strategy to attract more skilled talent and enhance its competitive edge in the global job market. Here’s what you need to know about the upcoming changes.

Key Changes in the Employment Act
  1. Removal of Labor Market Test for Select Countries: Employers in the Czech Republic will no longer need to conduct a labor market test for non-EU nationals from Australia, Canada, Israel, Japan, New Zealand, Singapore, South Korea, the United Kingdom, and the United States. This means that:

    • Employers are not required to publish a vacancy for positions filled by nationals from these countries.
    • There is no longer a mandatory 30-day waiting period for approval when changing employers.
     
          It is important to note that this exemption does not apply to Blue Card holders or applicants.

  2. Online Submission for Labor Office Procedures: All labor office registrations, deregistration, and related changes must now be submitted online. This applies to changes such as employer shifts or employee transfers, moving away from traditional mail or in-person submissions

  3. Online Portal for Posted Worker Notifications: Notifications regarding posted workers must be submitted through the labor inspectorate’s online portal instead of local labor offices.

Additional Information

Eligible foreign nationals still need to register their employment status with the relevant regional branch of the State Labor Inspection Office, even though the labor market test requirement has been lifted. Furthermore, they must obtain and maintain a valid residence permit or visa.

For employers, this means:

    • No need to announce job vacancies at the labor office.
    • No requirement to generate a job vacancy number for application purposes.
